TERMS OF SERVICE & CONDITIONS – LIQUIDATION DELUXE

This website is operated by Liquidation Deluxe Inc.
Throughout the site, the terms “we,” “us,” and “our” refer to Liquidation Deluxe.

By accessing our website and/or purchasing from us, you agree to be bound by the following Terms & Policies, which apply to all users of the site, including browsers, customers, merchants, and contributors.


1. TERMS & CONDITIONS OF SALE


1.1 Nature of Our Products

All products sold on liquidationdeluxe.com are brand-new items sourced from overstock, clearance, cancelled orders, end-of-line inventories, and open-box inventory.

Open-box items are not used and not refurbished. They are brand-new products that may have been opened for inspection, display, photography, or due to a cancelled order.

The condition of each product is clearly stated on its product page, and customers are responsible for reviewing this information prior to completing a purchase.

Liquidation Deluxe does not sell used or refurbished products.


1.2 Quantities & Availability

All products are offered in limited quantities and are available while supplies last.
Once sold out, items may not be restocked.

We reserve the right to:
• Limit quantities per order
• Restrict sales to specific customers or regions
• Cancel orders due to inventory discrepancies or system errors


1.3 Returns & Refunds

Returns are accepted within 10 days of delivery, except for items clearly marked “Final Sale” on their product page.

Return conditions include:
• Items must be new, unused, and returned in original packaging
• Customers are responsible for return shipping costs
• A 15% restocking fee applies to approved returns
• Delivery, handling, and storage fees are non-refundable

Any visible damage related to delivery must be reported within 24 hours of receipt, with clear photos.

1.4 Inspection at Delivery

Customers are responsible for inspecting their order upon delivery, including:
• Product condition
• Packaging integrity
• Order accuracy

Any damage related to transportation must be reported within 24 hours of delivery.

Claims submitted after this period may be refused, as the item will be presumed to have been received in acceptable condition.

Once delivery is accepted, responsibility for the product transfers to the customer.


1.5 Delivery Terms

Delivery is handled by third-party carriers and is typically curbside or entrance delivery, unless otherwise specified.

Additional services (room-of-choice, assembly, special handling) may be available for an added fee.

Customers must be present during scheduled delivery windows.
Missed or refused deliveries may result in rescheduling, storage, or additional delivery fees.


1.6 Pricing Errors & Order Cancellation

In the event of pricing, listing, or system errors (including but not limited to incorrect prices, $0 listings, or technical glitches), Liquidation Deluxe reserves the right to cancel the order.

Such errors do not constitute valid contractual consent under applicable Quebec law.


1.7 Accuracy of Information

We strive to ensure all information on our website is accurate and up to date. However, content may occasionally contain typographical errors, inaccuracies, or omissions.

We reserve the right to correct errors and update information at any time without prior notice.


1.8 Minor Variations & Product Expectations

Due to the nature of liquidation and open-box inventory, minor cosmetic variations, packaging wear, or slight imperfections may occur and do not constitute a defect.

Product images are for reference only. Actual colors or finishes may vary slightly due to lighting or screen settings.


1.9 Limitation of Liability

All products and services are provided “as is.”

Liquidation Deluxe shall not be liable for:
• Improper product use
• Third-party delivery delays
• Indirect, incidental, or consequential damages

Our total liability shall not exceed the purchase price of the product.


1.10 Intellectual Property

All content on liquidationdeluxe.com, including text, images, branding, logos, and designs, is the exclusive property of Liquidation Deluxe Inc.

Unauthorized use, reproduction, or distribution is strictly prohibited.


1.11 Force Majeure

We are not responsible for delays or failures caused by events beyond our reasonable control, including but not limited to natural disasters, supply chain disruptions, labor disputes, government actions, or pandemics.

Users agree not to:

Any dispute shall be submitted to the exclusive jurisdiction of the courts of the District of Montréal, Quebec.
